Terms of Service

1. Definitions

• You, Customer, Subscriber, or End-User: An individual or legal entity using the Service.
• Terms of Service or Terms: This Service Agreement.
• Service: The offering from Vulnissimo.io, including tools and functionality via web interface or API.
• Service Infrastructure: Systems operated by Vulnissimo.io to support the Service.
• Network Security Audits: Audits identifying security issues through scanning, port connections, and service evaluations.
• Web Security Audits: Website crawling and testing for forms, responses, or file presence.
• Device or Devices: Computer or electronic hardware or associated software.
• Hostnames: Names used to identify devices.
• URLs: Website addresses.
• IPs or IP Addresses: Device addresses.
• Support: Technical help provided via electronic means.
• Confidential Information: Any defined confidential or proprietary information.
• Intellectual Property Rights: Legal rights related to intellectual property.

2. Ineligible Parties

You may not subscribe if:

• Convicted of internet-related crimes;
• Overdue on payments to Vulnissimo.io;
• A competitor;
• In a restricted region;
• Previously refused service.

Vulnissimo.io may refuse access at its discretion.

3. Your Identity and Authority

You must provide accurate information and certify that users have authority to act on your behalf. Cooperation to verify identity is required.

4. Prohibited Uses

a. Scanning of Third-Party Devices

You must not direct scans at unauthorized IPs/Devices or create excess load.

b. Reasonable Usage

Avoid overloading the Service Infrastructure.

c. Unlawful Activities

Do not perform illegal activities, including copyright violations.

d. Unauthorized Access

• Do not access or distribute unauthorized information;
• Report accidental access immediately to contact@vulnissimo.io;
• Do not share accounts or credentials;
• Unauthorized access leads to immediate termination and possible legal action.

Third-party access is not permitted without written approval.

5. Support

Support is available during CET business hours. Extension to other zones is discretionary.

6. Disclaimer of Warranties

The Service is provided “as is” with no warranty. Vulnissimo.io disclaims all warranties, including merchantability, fitness, and non-infringement. Liability for damages is limited.

7. Copyright and Intellectual Property

The Service is protected under IP laws. Users gain a limited use license. Ownership remains with Vulnissimo.io.

8. Privacy

Vulnissimo.io may collect non-identifying technical data. Parties must comply with applicable data protection laws. Vulnissimo.io may refer to customer names unless explicitly denied in writing.

9. Confidentiality

Confidential Information includes all technical and business details marked or understood to be confidential. Recipients may use it only for intended purposes and must protect it. Disclosure is allowed only under legal requirements with prior notice.

10. Changes in Service

Vulnissimo.io may change or discontinue the Service or audit methods at its discretion.

11. Audit Authorization

You authorize Vulnissimo.io to perform audits on specified IPs, Hostnames, and URLs. This may involve probing, exploitation, or data extraction.

12. Suspension

Vulnissimo.io may suspend the Service or audits at any time.

13. Storage of Scan Data

Scan data is retained for one calendar year.

14. Incorrect Result Reporting

By submitting incorrect results, you authorize Vulnissimo.io to reproduce scans on your infrastructure to improve tool performance.

15. Beta Testing

Beta services are provided “as is” without warranties. You must provide truthful feedback without expecting compensation.

16. Indemnity

You agree to indemnify Vulnissimo.io against claims arising from your breach or violations of law.

17. Limitation of Liability

Liability is limited to the greater of the amount paid that year or $5.00. Limitations apply to the fullest extent of the law.

18. Term and Termination

Failure to follow Terms may result in termination. Expired accounts are considered revoked.

19. Entire Agreement

This Agreement supersedes prior communications. Conflicting terms in your documents are void. The English version prevails. Terms cannot be assigned by you. Vulnissimo.io may amend the Agreement.

20. Severability

Invalid provisions are modified minimally to be enforceable. Others remain in effect.

21. Governing Law

This Agreement is governed by Romanian law. Legal actions occur in Romania. No arbitration or class action. Injunctive relief may be sought.

22. Equitable Relief

Vulnissimo.io may seek equitable relief, including injunctions, for breaches.

23. No Waiver or Delay

A delay in enforcing rights does not waive those rights.

24. Force Majeure

Non-performance due to uncontrollable events does not create liability, except for payment obligations.
